独立中文笔会惊悉,本会会员杜导斌于今天上午11点左右在湖北省应城市医疗改革办公室工作地点被警方带走;警方指称杜在其缓刑期中违反了有关法律规定,发表了100多篇文章,将其缓刑改为收监实服刑。随后,孝感市公安局及其所属应城市公安局人员搜查了他的家,抄走了电脑及一些文稿材料,包括亲属寄放其家的电脑和家属在其过去被拘押期间收到的慰问信。
但是,警方除了为杜的家人留下一份抄走物品的清单之外,并没有出示法院的新裁决或任何其它书面文件,也未通知其家属任何关押地点和联络方式。
杜导斌,现年43岁,中国著名异议作家,因在互联网上发表批评政府的文章,于2003年10月28 日被湖北省孝感市公安局刑事拘留,11月10 日逮捕;2004年6月11日被孝感市中级人民法院以其26篇文章的部分内容定为“煽动颠覆国家政权罪”,判处有期徒刑三年,缓刑四年,剥夺政治权利二年,但根据缓刑规定获释回家。杜随后提出无罪上诉,被湖北省高级人民法院于同年8月4日驳回;此后多次向各部门申诉,包括向全国人民代表大会常务委员会法制工作委员会提起违宪审查控诉,但均未获回音。
鉴于:
1)杜导斌于2004年6月11日根据孝感市中级人民法院的判决获释,到今年6月10日应已通过“缓刑四年”的“考验期”,只因其提出上诉就将其“考验期”延长至今,显然是对被告人依法上诉的额外惩罚,有违法理,是中国改革开放前滥用恶法的重演。
2)对杜导斌的原判决和目前的收监关押,既违背了保障言论自由的《中华人民共和国宪法》第35条和中国早在10年前已签署的《关于公民权利和政治权利的国际》第19条,更损害中国政府早在7年前获得今年北京奥运会主办权时关于改善中国公民的人权承诺的声誉和全世界对中国社会进步的期待。
为此,独立中文笔会强烈抗议湖北省孝感市有关当局在奥运会前18天将杜导斌收监关押的行动,并呼吁:
1)立即无条件释放杜导斌,并尽快归还所查抄的所有私人物品;
2)确保杜导斌在被关押期间的人身安全,以及会见律师和亲属的法定权利;
3)国际社会敦促中国当局近快履行奥运承诺,在北京奥运会开幕式前释放包括本会其他会员师涛、张林、杨天水、力虹、严正学在内的全部因言获罪系狱者。
